TERMS AND CONDITIONS General 1. Unless otherwise specified, the minimum age for enrolment is 16. 2. Your registration, enrolment and deposit for any of our programmes constitute a binding agreement for you to complete the course and pay the fees in full. 3. You are expected to attend lessons regularly and comply with all Home Office regulations regarding attendance, where required. Students should only be absent from school in cases of sickness or authorised holiday. 4. Students are expected to complete all parts of the course programme, including all required assignments and tests. 5. Students are expected to arrive for classes on time and late entry to class is at Crest Schools of English’s (Crest’s) discretion. 6. It is your personal responsibility to keep Crest informed of all changes in personal circumstances, especially any changes to your telephone number, address in the UK or in your home country, email address and next of kin contact details in case of emergency. 7. Holidays may be taken by arrangement at any time with a minimum of two weeks' prior notice. 8. Crest reserves the right to terminate a student’s course without refund where attendance falls below the required level. 9. Crest will award a course completion certificate only where a student’s attendance has been in accordance with clauses 3 and 4 above. 10. No food or drink other than water may be consumed anywhere on the premises other than in the Student Area. 11. All mobile phones must be switched off during classes. 12. In the event of a student’s misconduct, unsatisfactory work or attendance, Crest reserves the right to refuse admission, suspend or expel the student without refund. 13. Students are expected to conduct themselves in an orderly and respectful manner. Crest does not tolerate aggressive conduct or abusive language towards members of staff and/or other students, nor deliberate damage to school property and in such cases will hold the student concerned directly responsible for any costs incurred. 14. Crest reserves the right to alter course programmes, fees, timetables or location of study at its sole discretion. 15. The average number of students in class is 12 with a maximum of 16. 16. Crest reserves the right to merge or split a class at any time and to substitute teachers as Crest in its sole discretion deems necessary. 17. All course fees must be received before course commencement. 18. Where a student initiates any change to the agreed programme, Crest may at its sole discretion charge an additional administration fee of 30 GBP. 19. Students are responsible for all bank charges where applicable. 20. Course fees do not include books or other study materials unless specifically indicated. Students will be expected to buy a book which will be in the region of 20 GBP per course,. 21. Travel expenses, accommodation, airport pickup, social activities, external examination fees, personal and health insurance, bank charges or additional course materials are not included in course fees, unless specifically stated but may be arranged and paid for separately. (Airport pickup - please note that where unforeseen delays occur, an additional hourly charge may have to be made.) 22. Crest will not be held responsible for lost or delayed post. 23. Crest will not be held responsible for loss or damage to private property including bikes left outside Crest premises. 24. Crest operates a no-smoking policy throughout its premises. 25. Crest reserves the rights to all photographs which may from time to time be taken of students for promotional and/or publicity purposes. Crest shall retain the copyright in all such photographs and reserves the right to use such photographs as it feels appropriate for advertising purposes. 26. Crest will not be held responsible for changes introduced by the Home Office which might affect students’ status. 27. Crest recommends all students to arrange private medical and travel insurance prior to leaving their home country. Additional Terms & Conditions applying specifically to Work Experience/Placement Programmes and Sandwich Courses 28. The minimum age for acceptance on this Programme is 18 and the maximum age is 35. 29. Non-EU participants must hold a valid student visa. 30. Crest will take all reasonable steps to place you on a work placement appropriate to your qualifications and preferences. Where however your assessment test and interview indicate that you may be insufficiently qualified for the requested placement, Crest reserves the right to offer additional and/or alternative courses or programmes. 31. Students being assigned work placements after arrival in the UK will be offered a maximum of two placements. If students reject the initial placement, an alternative will be offered. If both placements are refused, Crest is not obliged to offer further placements. 32. Where Crest or its nominated agent acts as an intermediary in arranging the work placement, that placement will be subject to an agreement between yourself and the company offering the placement. When agreement has been reached between you and the organisation offering the placement, this will be subject to a contract to which Crest will not be a party. Crest will however participate in monitoring the placement. 33. Crest will take all reasonable steps to provide the highest quality of tuition and work experience to students enrolled on this Programme. Crest is solely responsible for providing the language training component of the Programme but may act merely as an intermediary in arranging the placement. 34. You must complete the work placement at the company where you are initially placed 35. You must complete the English Language tuition element of the programme with Crest. If you enrol in an English language course or accept English language tuition at any other school or institution during the term of your Work Experience/Placement Programme and/or Sandwich Course you will be in breach of the terms of the programme. 36. Your rights and obligations during the term of the placement will be regulated by UK employment law. 37. You must abide by the rules and regulations of the placement provider organisation. 38. Under UK law, an employer has the right to terminate a worker’s employment with one week's notice and to instantly dismiss an employee in the event of gross misconduct. 39. If you are unhappy with your work placement you may request an alternative placement although an alternative placement cannot be guaranteed. 40. If you leave your work placement without first having tried to resolve your problems with your placement provider supervisor or with the assistance of Crest, or if you are dismissed by your employer because of your failure to comply either with their regulations or their reasonable expectations or if you leave your work placement without your Employer's or Crest's written permission, then Crest may remove you from the Programme without refund or recourse. 41. Should a placement offer be withdrawn at short notice or where a student claims unfair dismissal or treatment by the placement provider organisation, where substantiated and while another suitable placement is organised, the student will be offered General English tuition at Crest. An alternative placement offer cannot be guaranteed by Crest. Payment 42. All fees are payable in pounds sterling. Payment may be made by: (a) Bank transfer direct to: Barclays Bank Plc, 126 Station Road, Edgware HA8 7RY, England Account Name: Crest Schools of English Account Number: 70278734 Sort Code: 20-29-37 All bank charges must be paid by the student. A copy of the bank transfer details and the student's name must be forwarded to the school before a Letter of Acceptance can be sent. (b) Sterling cheque drawn on a UK bank (c) Traveller's cheque (d) Credit/debit card (not Diners or Amex). Please contact our office on +44 20 8952 8040 and have your credit card details ready. Please note credit card payments are subject to a 3% credit card handling charge. Cancellation of courses 43. If you decide to cancel your course more than 14 days before your course commences and prior to your arrival in the UK, you must return your Letter of Acceptance immediately. Subject to the Crest's discretion, you may be refunded your full course fees less an administration charge of 150 GBP, 40 GBP accommodation arrangement fee and one week's accommodation fee, where applicable (notification must be received in writing). 44. If you cancel your course less than 14 days before your course commences and prior to your arrival in the UK, you must return your Letter of Acceptance immediately. In special circumstances, and at Crest’s discretion, we may refund your full course fees less an administration charge of 150 GBP, 40 GBP accommodation arrangement fee and one week's accommodation fee, where applicable (notification must be received in writing). 45. Course fees are not transferable. 46. Crest reserves the right to cancel or alter a course and will, at its discretion, offer either an alternative course or a refund. 47. In all other circumstances tuition fees are refundable only in exceptional circumstances at the sole discretion of Crest. In the event of a Visa Refusal 48. In the event of entry into the UK being refused, official documentation of the application refusal and all original documents from the school must be sent to us before a refund can be considered. 49. Where a refund is to be issued, full course fees less an administration charge of 150 GBP, 40 GBP accommodation arrangement fee and one week's accommodation fee, where applicable, will be returned. 50. Where a visa has previously been refused and you have not informed Crest of that fact at the time of your application and a visa is subsequently refused, no refund will be made. 51. If a visa is refused on the grounds of poor or non-attendance no refund will be made. 52. If a visa is refused because the relevant Home Office, British Embassy, Consulate or Port of Entry immigration officials believe you are not a bona fide or genuine student no refund will be made. 53. You are strongly advised to take out adequate insurance cover in your own country prior to departure to provide for any losses arising as a result of visa refusal. Cancellation of Accommodation after Arrival 54. You must give your Homestay host and Crest at least 2 weeks' notice in writing if you decide to leave your accommodation. Public holidays: No reductions in fees are made for courses that include public holidays. One-to-one tuition will be rearranged. 55. Force Majeure: Crest shall not be deemed in default of its obligations to the extent that performance of its obligations or attempts to cure any breach are delayed, restricted, or prevented by reason of any act of God or government, fire, natural disaster, labour stoppage, insufficient demand for any classes, the failure of necessary power systems or connections, or any other act or condition beyond the reasonable control of the School, provided that Crest takes all reasonable steps to avoid or remove the causes of non-performance and continues performance immediately after those causes are removed. 56. The decision of the Principal is final and binding on all matters, both for students and teachers. 57. These Terms are governed by the laws of England and are subject to the exclusive jurisdiction of the Courts of England.
